Purchasing
from Moss Media - general conditions
Placing an order with Moss Media will be taken as a buyer's
acceptance of all the terms and conditions noted here.
You may, if wished, print out all or any part of the following
terms and conditions without restriction. If you are not
able to accept these terms and conditions, please do not
use the mossmedia.co.uk website.
In
the following paragraphs the 'seller' of goods and/or
services will be Moss Media, and the 'buyer' will be any
individual, sole trader, partnership, firm, company, co-operative
or any other body corporate placing an order with Moss
Media. 'Goods' or 'items' or 'services' will be those
items constituting the subject of a buyer's order. 'Contract'
means the actual contract for the supply of goods resulting
from Moss Media's acceptance of a buyer's order. Goods
sold are subject to these conditions, which can be varied
only in writing, valid only on countersignature by both
parties. We do not accept orders where the buyer is unable
to provide a valid fixed landline telephone number listed
as his private or business address, and we reserve the
right to refuse to accept any order or orders, howsoever
placed, without necessarily specifying a reason.
Under
no circumstances will Moss Media be liable for any indirect
or consequential loss however arising from any breach
or failure to perform obligations under a contract to
sell or supply goods or services listed on this site or
in catalogues or price lists published elsewhere by Moss
Media, or obtained specially for clients or customers.
Your
use of the mossmedia.co.uk website and purchases made
by you, of any item or service listed for sale, rental
or supply, will be governed by English law, and deemed
to have taken place within the United Kingdom.
Prices
Prices quoted are the latest available. We do our best
to hold prices, but nothing stays the same for ever, so
prices are subject to change without notice, and are reviewed
at monthly intervals. All prices quoted exclude carriage
and VAT. We reserve the right to charge prices ruling
on the day goods are despatched.
Carriage and handling.
For maximum flexibility we offer various options for delivery
of parts and equipment ordered. We
recognise carriage charges can be a significant additional
cost on many orders and make every effort to minimise
such charges whilst still using the preferred method selected
by online shop customers. We are sometimes able to consolidate
packaging on multiple item orders, reducing a calculated
carriage charge total, particularly if several higher
value items are to be despatched. We therefore reserve
the right to reduce your carriage charges wherever possible
by use of a different carriage method or courier whilst
staying within your originally chosen carriage timescale.
Credit accounts and despatch terms
Unless you hold a pre-approved credit account with us,
which is not in arrears, items will not be despatched
until cleared funds for the full invoiced value including
carriage charges have been received by us. Please allow
at least 10 working days for cheque payments to clear.

Deliveries
and availability
We make every effort to despatch stock items on the day
orders are received - so long as funds are cleared in
full and complete payment before the cut-off time for
collection or despatch by the chosen carrier. Please note
we can neither guarantee despatch, availability, or delivery
time of items not currently in stock, nor guarantee delivery
timings for items despatched and delivered via postal
or courier services provided by others. We endeavour to
use quality services and suppliers but accept no responsibility
or liability for the services they provide.
Out
of stock items
Some items may from time to time be out of stock. If this
is the case, we will offer a part delivery if possible,
and advise you of the delay and a likely timescale for
despatch of the remaining items as soon as possible after
receipt of your order. Such anticipated delivery times
are based on information made available to us by external
suppliers. We will update this information whenever possible,
but cannot guarantee its accuracy. Whilst we may despatch
part orders as above, we will not despatch substitute
goods without prior customer approval.
UK
VAT and export sales
Invoices raised against orders placed in England, Scotland,
Wales and Northern Ireland for services provided or goods
to be delivered to addresses in those areas will automatically
have Value Added Tax added at the prevailing rate, currently
17.5%. Orders can be accepted for delivery and invoicing
outside these areas, and such invoices may be UK VAT free.
Please contact our export sales department to discuss
orders for despatch to any part of the world.
Guarantees
and Warranties
New and unused products supplied by Moss Media carry their
manufacturers warranty, usually valid for a period of
12 months on a 'return to base' arrangement on most (but
not all) new items. Ex-demonstration equipment may have
shorter warranties. You are also advised that some warranties
on domestic-level equipment may not be valid if that equipment
is modified or used in a professional environment. Used
equipment does not normally come with a warranty unless
you are advised otherwise at the time of purchase. Please
see the section 'Rights under UK distance selling regulations'
for details concerning warranties on video and audio media
products and batteries. None of the foregoing affects
any applicable statutory rights.
Unless
otherwise stated, new parts and equipment and media products
despatched by Moss Media will be factory fresh and in
working order. If goods prove faulty or damaged when you
receive them, please report the problem by contacting
Moss Media by e-mail or telephone within 3 working days
of receipt. Provided no seals have been broken, equipment
which is undamaged but electrically or mechanically faulty
will be uplifted and repaired or replaced without charge,
or you may opt for a full refund of the sum paid. Items
which have received transit damage will usually require
inspection by the carrier before return, and in this event
we ask that you retain all packaging material as well
as the equipment on your premises until the carrier has
been informed and arrangements made for any necessary
inspection. We will then progress a repair or replacement
item as quickly as possible, or again you may opt for
a full refund.
Goods
returned under warranty or for a refund must have been
used in compliance with manufacturer requirements, recommendations
and instructions, and must not have been adjusted, modified,
altered or adapted. Returned items must be complete in
all respects and in original condition, with all original
packing materials, connecting leads, handbooks and originally
supplied accessories.
Items
within their warranty period proving faulty after a period
of use will be repaired or replaced at our discretion.
Parts or equipment failing through normal wear and tear
within the warranty period should be returned carriage
paid, and insured where necessary, to Moss Media. We will
arrange either for replacement or repairs to be carried
out, and return the equipment carriage paid. Please note
that warranty repairs can take considerable time to process,
and this timescale is outside the control of Moss Media.
Equipment outside the warranty period may be returned
to us carriage paid for repairs or maintenance, in which
case written information concerning known faults, and
an official order covering the work required must both
be enclosed. Estimates or quotations will always be provided
before work commences on non-warranty repairs.
Moss
Media's liability to the buyer in respect of new equipment
or parts warranty claims will not exceed the price paid
by the original buyer of the goods on which the warranty
claim is being made.
Shortages
If on receipt there appear to be shortages against your
order, please check the advice note to ensure that you
have not received a part delivery. We always try to despatch
complete orders, but where this is not possible we offer
to despatch whatever stock we have available, followed
by an 'order completion' despatch at a later date. If,
having checked for a part delivery, there is a definite
shortage in your consignment, please report the problem
by contacting Moss Media by e-mail or telephone within
3 working days of receipt.
Rights
under UK Distance Selling Regulations 2003.
In order to provide the best possible service, we aim
to apply the DSR requirements to both private and business
customer transactions. Under these regulations, consumers
have the right to cancel a contract to purchase an item
within 7 days of its delivery to the customer's premises,
and receive a refund of monies paid within the following
30 days. If you choose to exercise this right, you must
take reasonable care of the goods, and you are responsible
for carriage and insurance costs in returning the unwanted
goods to Moss Media. We reserve the right to deduct carriage
(or other) charges from any refund due if such charges
are not paid in advance, or the goods are damaged, or
not returned within 30 days. If the goods are faulty,
or were despatched to you in error, we will pay return
carriage charges. Please note you cannot return items
under the DSR regulations if the goods involved were ordered
from Moss Media as a custom built or modified design,
or built to customer specifications. Whilst we may despatch
part orders where the total number of items requested
is not immediately available from stock, we will not despatch
substitute goods without prior customer approval.
PLEASE NOTE WE ARE UNABLE TO ACCEPT THE RETURN FOR
ANY REASON OF ANY BATTERIES, VIDEO, AUDIO OR OTHER RECORDABLE
OR PLAYABLE MEDIA PRODUCT WHERE THE PACKAGING SEAL HAS
BEEN BROKEN OR TAMPERED WITH.

Payment
We accept payment by cash, company cheque and BACS transfer,
subject to acceptance. Monthly credit accounts may be
available to authorised purchasers - please ask for an
application form. Where goods are provided on monthly
credit account, payment in full is required no later than
30 days after invoice date. No payment shall be unreasonably
withheld. We reserve the right to add monthly interest
at 5% of the total amount outstanding for any invoice
not paid within the above timescale and/or withdraw credit
facilities from buyers in default of these payment terms.
The title to, and ownership of, all goods and services
supplied by Moss Media does not pass to the buyer until
the agreed price for all sums due to Moss Media has been
paid in full.
If
a buyer fails to make payment when due, becomes insolvent,
makes an arrangement with creditors, is declared bankrupt,
or enters into voluntary or compulsory liquidation or
has an administrative receiver appointed over any or all
assets, Moss Media reserves the right to take action as
it sees fit to recover all or part of any outstanding
debts. Such action may include, but is not limited to:
entering without notice premises where goods remaining
unpaid are known to be located, in order to recover such
items; requiring a buyer not to relinquish possession
of such unpaid goods until Moss Media has received payment;
and the withholding of delivery of ordered but undespatched
goods.
Privacy
policy
We are registered for the processing of data under the
Data Protection Act 1998.
So that the goods you have requested can be despatched
and invoiced, information is collected during the ordering
process when orders are placed by telephone, e-mail and
in writing. Information is not collected on our behalf
by any third party, and we do not sell or divulge customer
or client details or information, however provided, to
any other organisation or third party for marketing or
other purposes.
We
do not routinely despatch marketing material to individuals
or companies as a result of information provided or gathered
during order placement.
